The California Supreme Court's decision to overturn the traditional definition of marriage continues the voters vs. the court dance that's been going on now for a decade. But the polling data on the ballot issue, which will put the question to the voters of whether to amend the state constitution this November, actually still looks like it has a better than average chance of passing...likely not by the overwhelming margin it did in 2000, when Prop 22 received 61 percent of the vote, but by a decent margin nonetheless.
It says a great deal that Gov. Schwarzenegger has twice vetoed the legislature's attempt to pass a same-sex marriage measure. While a social liberal like Schwarzenegger might naturally be predisposed to allow such a policy, the will of the voters is still strong enough to prevent him from doing so - he wants to pass the buck to the voters. Which is, let's face it, the right decision - we'll see if the voters respond again. More reax here.

The California Supreme Court overturned a ban on gay marriage Thursday, paving the way for California to become the second state where gay and lesbian residents can marry.

UPDATE (Dan McLaughlin): Howard Bashman has the breakdown of the 4-3 decision, which apparently rests on state constitutional grounds and thus can't be appealed to the U.S. Supreme Court, here along with links to the 172-page opinion.

Building on the USAToday/Gallup poll which revealed that "55 percent of likely Democratic voters say both Sens. Hillary Clinton, D-N.Y., and Barack Obama, D-Ill., should stay in the race" for the Democratic presidential nomination, we now have a Rasmussen poll which says the following:
[I]f Clinton does not win the Democratic Party nomination, 29% of Democrats say she should run an Independent campaign for the White House.
Further, according to Rasmussen, "6% [of Democrat respondents] want both candidates to drop out."
The excellence continues.

UPDATE: Columbus Dispatch says he is trying to negotiate a deal:
Ohio Attorney General Marc Dann apparently is trying to negotiate the terms of his resignation, adamant that a bill be killed authorizing Inspector General Thomas P. Charles to investigate the scandal in Dann's office.
Sources said Dann told a number of legislators that an investigation by Charles "would cause all sorts of problems for him and he offered to leave office if the bill is scotched.
All sorts of problems is right! Sounds like he would like to avoid any more investigation and legal repercussions.
Ohio Attorney General Marc Dann is expected to announce his resignation later today, The Plain Dealer has learned. He planned to break the news to his senior staff this afternoon.
The decision came as Dann faced intense pressure both from fellow Democrats and Republican critics who said he was not fit to continue as the state's top lawyer.
If Dann resigns Gov. Strickland would name a replacement to serve until a successor is elected this November.

According to UPI:
A USA Today/Gallup poll released before Tuesday's West Virginia primary indicates a majority of Democratic voters say they want the nomination race to continue.
The poll of 1,017 national adults conducted May 8-11 indicates 55 percent of likely Democratic voters say both Sens. Hillary Clinton, D-N.Y., and Barack Obama, D-Ill., should stay in the race.
How nice that a majority of Democrat voters would like the nomination fight that is tearing their party asunder on racial lines to continue into the summer, giving Republican nominee John McCain more time to define himself and hone his message while his general election opponent is still distracted by intraparty political warfare.
As Mr. Burns would say: "Excellent."

The Sacramento Bee is coming after State Sen. Tom McClintock, California's best known conservative and candidate to Rep. Doolittle's seat in district 4.
Oh yes, he's "intolerant," an "ideologue," and worst of all, he's anti-earmarks. The Bee quotes approvingly of an attack by a supporter of former Rep. Doug Ose's, who is running against McClintock to return to the Congress, who says in horror "Tom will publicly refuse the tools available to all 435 members of Congress."
As for me, I'm with the Republican quoted at the end of the article:
"I think Tom is probably the most active voice in restraining state spending," said state Sen. Sam Aanestad, R-Penn Valley, a campaign supporter. "He just tells it like it is. He's upfront and he doesn't play political games.
"If that's a weakness, it's one I'd like to have."
For what it's worth, I'm with McClintock for Congress, and against Ose. This is a district we can have our pick of Republicans. This is no time and no place to go with a pro-spending Republican.

According to this article, McCain has been portraying Obama as inexperienced, self-entitled and effete, a candidate coddled by a loving press corps and lacking the judgment necessary for the highest office in the land. We'll see if it works, but if that was the strategy it was certainly a successful three months in "defining your opponent."

From the Long War Journal comes this report that Abu Suleiman al Otaibi, the "former leader of the legal system of al Qaeda in Iraq's political front, the Islamic State of Iraq," has been killed in Afghanistan.
That's right -- the al Qaeda leader who used to the supreme authority in Iraq on that Shari'a law that all AQ live by so devoutly was killed in Afghanistan.
But, you know, the War on Terror is only in one place, and doesn't cross those pesky national borders.

Obama added superdelegates from Utah and Ohio, as well as two from the Virgin Islands who had previously backed Clinton. The additions enabled Obama to surpass Clinton's total for the first time in the campaign.
